In this video, we will delve into the recent sensational Supreme Court verdict delivered on January 4, 2025, regarding the revocation of property rights of children who neglect their parents. This ruling is a significant milestone in the Indian judiciary. The Supreme Court has ruled that if children neglect the care and maintenance of their parents, the property rights given to them can be revoked. This decision is based on the 'Maintenance and Welfare of Parents and Senior Citizens Act, 2007'. According to the judgment by Justices C.T. Ravikumar and Sanjay Karol, tribunals are directed to conduct swift trials in such cases and restore the property rights back to the parents. The primary objective of this verdict is to provide financial security to elderly parents and to remind children of their duty towards the care and maintenance of their parents. This ruling particularly emphasizes that if parents can prove that their children are neglecting them, their property rights can be revoked, offering a sense of protection to the parents. This case initially surfaced when an elderly woman from Chhatarpur, Madhya Pradesh, filed a complaint against her son. Despite gifting some property to her son, he neglected her and even attacked her frequently demanding the remaining property. Eventually, the elderly woman sought justice in court, and her property rights were reinstated by the Sub-Divisional Magistrate. The High Court's single bench welcomed and upheld this decision. However, the division bench of the High Court overturned the ruling, awarding the property to the son. Consequently, the aggrieved woman approached the Supreme Court, and the bench of Justices C.T. Ravikumar and Sanjay Karol restored the rights of the elderly parents by revoking the gift deed given to the son. Through this verdict, elderly parents are assured of financial security and can live independently without relying on their children. It also encourages children to act responsibly towards their parents. In summary, this judgment serves as both protection for parents and a reminder of responsibility for children, marking a significant milestone in the Indian judiciary. Parents are empowered to live independently, and children who neglect their parents lose not only property rights but also the responsibility of parental care.
