Around 11:00 AM on January 20, 2025, Sergeant Michael Gulla with the Boonton Police Department responded to a report of a medical emergency in the area of Vreeland Avenue and Myrtle Avenue. He arrived on scene and observed that a 2018 Lexus GX4 was stopped in the middle of the road, and a female was unconscious behind the wheel while the vehicle was still in drive. He awakened her and asked her to exit the vehicle. The female was later identified as Jenna Matthews. Multiple air duster cans were visible in plain view inside the vehicle.

Jenna eventually exited the vehicle and Officer Michael Bost escorted her to the nearby McDonald’s parking lot to continue the investigation. Jenna denied consuming alcohol, but admitted to inhaling from the air duster, and a white substance was visible around her nostrils. Based on the officers’ suspicion of impairment, Jenna was asked to perform field sobriety exercises.

Following the field sobriety exercises, Jenna was evaluated by first responders before being handcuffed and placed in the patrol car. She consented to a search of her vehicle, and the search yielded the presence of multiple air duster cans inside the vehicle. After the officers searched her car, Jenna was transported to the Boonton Police Department for further processing. Her vehicle was subsequently impounded for a 12-hour hold according to John’s Law.

At police headquarters, Jenna was read the Standard Statement for Motor Vehicle Operators, and agreed to submit breath samples. However, the Alcotest machine detected interference during the administration of the breath test because of the left-over chemical residue in her mouth and it was terminated. After the officers were finished with their paperwork, Jenna was transported by first responders to Saint Clare’s Hospital in Denville Township for further evaluation. She was eventually released to her mother pending her court appearance after she signed the Potential Liability Warning form on Jenna’s behalf.

Jenna was issued the following traffic tickets:
-Operating under the influence
-Reckless driving
-Driving with a suspended license
-Delaying traffic

Jenna was also criminally charged with inhaling a toxic chemical to become intoxicated (2C:35-10.4B(1)) and possession of a toxic chemical to become intoxicated (2C:35-10.4B(2)).

All videos and case documents were obtained pursuant to the New Jersey Open Public Records Act, N.J.S.A. 47:1A-1 et seq. (P.L. 2024, c.16). Defendants are considered innocent until proven guilty.

The New Jersey Supreme Court has previously affirmed in Salzano v. North Jersey Media Group, 993 A.2d 778 (2010) that “The fair-report privilege reflects the judgment that the need, in a self-governing society, for free-flowing information about matters of public interest outweighs concerns over the uncompensated injury to a person's reputation.” This video advances a compelling public interest. The summary of events was based on records that are “open to public view through open access to public records” as defined in the Salzano case. In Ramos v. Flowers, 429 N.J. Super. 13, the Appellate Division of the Superior Court has also affirmed the right to film law enforcement interactions.
