CASE BACKGROUND: • Defendant Andrew KY appeared for a plea and sentencing hearing for misdemeanor disorderly conduct charges • He was already in custody after being revoked on drug charges (possession of amphetamine and cocaine) in Polk County • The prosecution and defense had reached a joint agreement for him to plead guilty with only court costs ($443) as punishment VICTIM IMMOTIONAL AND IMPACTFUL TESTIMONY: The victim (SB) gave an emotional impact statement describing severe abuse, including: • Physical violence (hitting her, bashing her head against a car window) • Firing a flare gun out of a sunroof during a drug-induced rage • Damaging her vehicle (ripping off mirrors and visors) • Breaking her glasses and destroying her phone • Causing her ongoing trauma requiring therapy, medication for nightmares, and daily panic attacks THE TURNING POINT: During the plea acceptance, Judge Mogen asked the defendant if he got into an argument and fight with the victim. His response: "I don't believe so," claiming he just drove away when she was yelling at him. JUDGE'S RESPONSE: Judge Mogen immediately terminated the plea deal with a firm "Good, we're going to trial," noting that if he claims innocence, the state must prove his guilt beyond reasonable doubt. She also expressed that the proposed punishment of costs-only was not in the public interest given the victim's testimony.
