Kesavananda Bharati & others Versus State of Kerala is one of the leading cases in the constitutional history of India. It is popularly known as the Fundamental Rights case. The Kesavananda Bharati judgement was a hard-fought legal battle between the two constitutional stalwarts and legal luminaries namely N.A. Palkhivala and H.M. Seervai.
The hearing in the Kesavananda Bharati case took place for sixty-eight long days and finally, a 703-page judgement was pronounced on 24th April 1973. This day marks 50 years of Kesavananda Bharati Case judgement. It was the Kesavananda Bharati case that brought the Basic Structure doctrine into the limelight. It held that the “basic structure of the Indian Constitution could not be abrogated even by a constitutional amendment”.
