Florida’s adoption intervention statute, codified as section 63.082, was revised in the 2016 legislative session to clarify and expand the best interest factors to consider when ruling on motions for change of custody, and to clarify that it is the best interest of the child that controls the court’s determination. How these changes are being implemented by trial and review will be explored. What procedure should be followed when a motion to intervene is filed? How do a child’s special needs play into this process? What should you do if the court rules against you? Strategies for applying the new laws and procedures with best practice tips will be discussed.
